1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Starbitech ("Company," "we," "us," or "our") concerning your access to and use of the GoSpinny website (gospinny.com) and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Service.
2. Eligibility
- You must be at least 13 years of age to use GoSpinny
- If you are under 18, you must have parental or guardian consent
- You must provide accurate and complete registration information
- You must not be prohibited from using the Service under applicable laws
3. Account Registration
3.1 Account Creation
- Free users can use basic features without registration
- Premium features require account creation
- You are responsible for maintaining account security
- You must not share your account credentials
- You must notify us immediately of any unauthorized access
3.2 Account Termination
- You may delete your account at any time via the contact form
- We reserve the right to suspend or terminate accounts for violations
- Terminated accounts may result in loss of data
4. Subscription Plans and Pricing
4.1 Free Plan
- Access to basic spin wheel features
- Up to 20 items per wheel
- Advertisements displayed
- No credit card required
4.2 Premium Plans
We offer the following Premium subscription plans:
Monthly Plan: $9.99/month
Yearly Plan: $59.99/year (equivalent to $4.99/month, saving 50%)
Premium Features Include:
- Up to 100 items per wheel
- No advertisements
- Unlimited cloud saves
- Export to CSV/Excel
- Premium color schemes and themes
- Priority customer support
5. Free Trial and Billing
5.1 7-Day Free Trial
IMPORTANT: When you sign up for a Premium plan, you receive a 7-day free trial. You will NOT be charged during the trial period.
After 7 days, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee.
To avoid charges, you must cancel BEFORE the 7-day trial ends.
5.2 Automatic Renewal
- Subscriptions automatically renew at the end of each billing cycle
- Monthly plans renew every month
- Yearly plans renew every year
- You will be charged automatically unless you cancel
- Renewal charges occur on the same date each period
5.3 Payment Processing
All payments are processed securely through Stripe.
We do NOT store or have access to your credit card information. All payment data is handled by Stripe, a PCI-DSS compliant payment processor.
By subscribing, you authorize Stripe to charge your payment method for the subscription fee.
5.4 Payment Methods
- Credit cards (Visa, Mastercard, American Express)
- Debit cards
- Other methods supported by Stripe
5.5 Failed Payments
If a payment fails:
- We will attempt to charge your payment method up to 3 times
- You will receive email notifications of failed payments
- If payment fails after 3 attempts, your Premium subscription will be automatically downgraded to the Free plan
- You will lose access to Premium features immediately
- You can reactivate by updating your payment method
6. Cancellation Policy
6.1 How to Cancel
You can cancel your Premium subscription at any time using one of the following methods:
Method 1 (Recommended): Email Cancellation
- Send an email to starbiztech@gmail.com
- Use our Contact Form
- Include your account email and reason for cancellation
- We will confirm cancellation within 48 hours
Method 2: Stripe Customer Portal
- Cancel directly through Stripe's billing portal
- Access via link in your subscription confirmation email
- If you cancel via Stripe, please notify us via email so we can update our records
6.2 Effect of Cancellation
IMPORTANT: You retain Premium access until the end of your billing period
- If you cancel on January 15th but paid for January 1-31, you keep Premium until January 31st
- No refunds for partial months - you've already paid for the full month
- After the billing period ends, you will be downgraded to Free plan
- Your data will be retained, but Premium features will be disabled
6.3 Cancellation During Trial
- If you cancel during the 7-day free trial, you will NOT be charged
- You will immediately lose Premium access
- No refund necessary as you were not charged
7. Refund Policy
NO REFUNDS FOR TIME ALREADY USED
We do NOT provide refunds for any subscription fees already paid and for time periods where you had access to Premium features.
7.1 Refund Eligibility
- NO refunds for partial months: If you cancel mid-month, you will NOT receive a refund for the remaining days
- NO refunds for unused features: Even if you didn't use all Premium features
- NO refunds for service dissatisfaction: Please use the 7-day trial to evaluate the service
7.2 Exception: Billing Errors
Refunds may be issued ONLY in cases of:
- Duplicate charges due to technical error
- Unauthorized charges (must provide proof)
- We charged you after confirmed cancellation

7.3 Future Billing
- When you cancel, future charges will stop
- You will NOT be billed for the next period
- Your Premium access continues until the current period ends
8. Payment Responsibility and Liability
WE ARE NOT RESPONSIBLE FOR PAYMENT PROCESSING ISSUES
All payments are processed through Stripe. We are NOT responsible for:
- Payment processing failures
- Declined transactions
- Fraud or unauthorized charges on your payment method
- Disputes with your bank or credit card company
- Currency conversion fees
- International transaction fees
- Any issues arising from Stripe's service
For payment issues, you must contact Stripe directly or your bank/card issuer.
8.1 Stripe Terms
By using GoSpinny Premium, you also agree to Stripe's Terms of Service: stripe.com/legal
8.2 Fraud Protection
Stripe provides fraud protection and secure payment processing. However, you are responsible for:
- Keeping your payment information secure
- Monitoring your account for unauthorized charges
- Reporting suspicious activity immediately
9. Acceptable Use Policy
You agree NOT to:
- Use GoSpinny for illegal purposes
- Upload offensive, harmful, or inappropriate content
- Attempt to hack, reverse-engineer, or compromise the Service
- Use automated tools (bots) to access the Service
- Resell or redistribute the Service
- Spam or harass other users
- Violate intellectual property rights
- Use the Service to conduct fraudulent activities
Consequences of Violations
- Immediate account suspension or termination
- No refund for paid subscriptions
- Legal action if necessary
- Reporting to law enforcement for illegal activity
10. Intellectual Property
10.1 Our Rights
- GoSpinny name, logo, and branding are owned by Starbitech
- All code, design, and content are protected by copyright
- You may not copy, modify, or distribute our intellectual property
10.2 Your Content
- You retain ownership of items you add to wheels
- By using cloud save, you grant us license to store and display your content
- We may use anonymized/aggregated data for analytics
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE"
We make NO warranties, express or implied, including but not limited to:
- Fitness for a particular purpose
- Merchantability
- Non-infringement
- Uninterrupted or error-free operation
- Accuracy or reliability of results
Use at your own risk. We do not guarantee that GoSpinny will meet your requirements or that results will be truly random (though we use industry-standard randomization).
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Starbitech and its owners, employees, and partners shall NOT be liable for:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Damages arising from use or inability to use the Service
- Damages from fraud, payment issues, or third-party services (like Stripe)
- Damages from decisions made based on wheel results
Our total liability is limited to the amount you paid us in the past 12 months, or $100, whichever is less.
13. Indemnification
You agree to indemnify and hold harmless Starbitech from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use of the Service
- Your violation of any third-party rights
- Any content you submit to the Service
14. Modifications to Service and Terms
14.1 Service Changes
- We may modify, suspend, or discontinue any feature at any time
- We may change pricing with 30 days notice for existing subscribers
- We are not liable for any modifications or discontinuations

- We may update these Terms at any time
- Changes will be posted with updated date
- Significant changes will be notified via email
- Continued use after changes = acceptance of new Terms
15. Governing Law and Disputes
